Terms of Service
Last updated September 5, 2026 · Legal version 2026-09-05
These Terms of Service govern access to and use of PocketESign. By creating an account, sending a signing request or otherwise using the service, you agree to these Terms. If you use PocketESign for an organization, you represent that you have authority to bind that organization.
1. The service
PocketESign provides tools to prepare, send, track and complete electronic-signature workflows. The service may use third-party infrastructure to render documents, deliver signing invitations, capture signatures and produce audit records or completion certificates.
2. Eligibility and accounts
You must have legal capacity to enter into these Terms and must provide accurate account information. You are responsible for maintaining the confidentiality of your login credentials and for activity performed through your account. Notify us promptly if you suspect unauthorized access.
Paid service eligibility. Paid credit packs may be purchased by individuals or organizations with legal capacity to enter into the transaction. PocketESign and its payment provider may use account, billing or payment information to determine whether a customer, country or transaction is supported and may change geographic availability from time to time.
3. Your responsibility for documents and recipients
You are responsible for the documents you upload, the recipients you invite and the legal basis for sending those recipients a signing request. You represent that you have the necessary rights and authority to upload the document, request the signature, provide recipient information and use the resulting signed record.
You must not use PocketESign to misrepresent a person's identity, create a fraudulent signature, send deceptive requests, harass recipients or obtain a signature without appropriate authority. The Acceptable Use Policy forms part of these Terms.
4. Electronic signatures are context-dependent
PocketESign is a technology service and does not provide legal advice. Electronic signatures may be legally effective in many transactions, but requirements differ by document, jurisdiction and circumstance. Some transactions are excluded from general electronic-signature statutes or require notarization, witnessing, identity verification, special disclosures or other formalities.
You are responsible for determining whether a particular document can validly be signed electronically and whether the workflow you choose satisfies applicable law. See our Electronic Signature Consent & Disclosure.
5. Transactions PocketESign does not currently target
Unless PocketESign expressly states that a specialized workflow is supported, you should not use the service for wills or testamentary trusts, adoption or divorce matters, court orders or official court filings, documents requiring notarization or an oath, or other transactions that applicable law excludes from ordinary electronic-signature rules. You should obtain qualified legal advice for sensitive or regulated transactions.
6. Signer consent and communications
Signing invitations and related reminders are transactional service communications associated with a document workflow. Customers must provide accurate recipient information and must not use signing invitations as a substitute for marketing email. Signers may be required to affirm their intent to sign and consent to the electronic process within the signing experience.
7. Third-party services
PocketESign relies on third-party services, including e-signature infrastructure, hosting, email delivery, analytics and payment processing. Those services may experience outages, maintenance or changes outside our control. We may replace providers where reasonably necessary to operate or improve PocketESign.
8. Availability and service changes
We may modify, suspend or discontinue features where reasonably necessary to maintain, secure or improve the service. Unless PocketESign expressly agrees otherwise in writing, the service is provided without a guaranteed service-level commitment.
9. Fees, credits and refunds
Paid credit packs are governed by the current Billing & Credits Policy. PocketESign uses one-time credit packs rather than a recurring subscription. Eligible paid purchases are processed through Stripe Managed Payments, where Stripe acts as merchant of record for the transaction. Prices, availability, taxes, refunds, disputes and credit treatment are governed by the checkout terms and the policy in effect when the purchase is made.
10. Intellectual property
You retain rights in documents and content you provide. You grant PocketESign and its processors the limited rights necessary to host, transmit, render, process, sign and return that content for the purpose of providing the service. PocketESign and its licensors retain rights in the software, branding, interface and service technology.
11. Feedback
If you voluntarily provide product feedback, you permit us to use it to improve PocketESign without an obligation to compensate you, provided we do not publicly identify you without permission.
12. Suspension and termination
We may suspend or terminate access where reasonably necessary to address security risks, unlawful use, fraud, abuse, material breach or legal requirements. You may stop using PocketESign at any time. Account data export and deletion requests are available through PocketESign's account and support workflows, subject to lawful retention and audit obligations.
13. Disclaimers
To the maximum extent permitted by applicable law, PocketESign is provided on an “as is” and “as available” basis. We do not warrant that every electronic signature will be enforceable for every purpose, that the service will be uninterrupted, or that a document is legally sufficient merely because it was processed through PocketESign.
14. Limitation of liability
To the maximum extent permitted by applicable law, PocketESign and its operator will not be liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of business or loss of data arising from use of the service. To the maximum extent permitted by law, PocketESign's aggregate liability for claims arising from the paid service will not exceed the greater of the fees paid by the customer to PocketESign during the 12 months preceding the event giving rise to the claim or USD $100. This limitation does not apply where applicable law prohibits or restricts it, and nothing in these Terms excludes mandatory consumer rights that cannot lawfully be waived.
15. Indemnity
Where permitted by law, customers agree to defend and indemnify PocketESign against third-party claims arising from documents they upload, recipient data they provide, unlawful signing requests, infringement of third-party rights or material violation of these Terms. This clause does not limit rights that cannot lawfully be waived, including mandatory consumer protections where applicable.
16. Governing law and disputes
These Terms are governed by the laws applicable at the PocketESign operator's place of establishment identified in the Legal Notice, without regard to conflict-of-laws principles, except where mandatory law requires otherwise. Disputes will be submitted to the courts that have jurisdiction under applicable procedural law, without limiting rights or remedies that cannot lawfully be waived.
17. Changes
We may update these Terms as PocketESign evolves. Material changes will be communicated where required. Continued use after an effective update constitutes acceptance where permitted by law.
